The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is a contagious disease and is believed to spread mainly from person-to-person contact.

The Township of King has put in place preventative measures that meet or exceed recommendations from the Ontario Ministry of Health to reduce the spread of COVID-19 at its facilities. However, neither the Township of King, nor its facility User Groups or volunteers can guarantee that you or your child(ren) will not potentially come into contact with, or become infected with COVID-19. Further, as a public venue, attending a Township of King facility could increase your risk and your child(ren)’s risk of contracting COVID-19.

As a condition of the permission granted by the Township of King to enter onto its premises, all Users are required to acknowledge and implicitly agree as follows:

a. Users voluntarily assume the risk that they or their child(ren) may be exposed to or infected by COVID-19 by attending a public facility hosting community programs or activities and that such exposure or infection may result in personal injury, illness, permanent disability, and/or death. They understand that the risk of becoming exposed to or infected by COVID-19 at the facility may result from the actions, omissions, or negligence of myself and others, including, but not limited to, the Township of King employees and volunteers, and program participants and their families, or registered volunteer organizations.

b. Users further acknowledge that attending enclosed premises during a pandemic is a voluntary decision with an inherent risk to contact an infectious disease without a known treatment or cure. Users willingly and voluntarily choose to take this risk and, as such, cannot hold the Township of King, its employees, agents, representatives, User Groups or volunteers liable for any damages or loss associated with COVID-19 resulting from their attendance at a Township facility.

c. Users acknowledge and agree that they will be required to participate in active screening prior to entering any Township facility which may include duplicate requirements of their organization and the Township of King. Users agree and acknowledge that they will comply with any public health requirements, use of personal protective equipment, health screening and contact tracing requirements that may be imposed as a strict condition of participating in events hosted in Township facilities.

d. Users further acknowledge that the Township may share such personal information, including but not limited to COVID-19 test results, as is necessary for the purpose enforcing any applicable public health mandates, including contact tracing, and enforcement of quarantine requirements.

2. The group will provide to the Township confirmation in writing that they have communicated the above to all members once completed.

3. The group agrees to take any and all up-to-date safety precautions promoted in an official capacity by various Canadian health authorities, including Ontario Health, Health Canada, etc., while using the Township of King’s premises, particularly but not limited to those involving hand washing, social distancing, the wearing of masks, etc.

4. The group agrees that the group will carry at all times from the date of signing this document onward liability insurance which covers all risks, including but not limited to coverage for personal injury and any other liability resulting from exposure to COVID-19.

5. Upon review of the agreed upon Acknowledgement of Risk, if participants of the group choose not to participate or attend a Township of King facility, the Township shall not be responsible for any losses in revenue to the group.

6. The group has read this document in its entirety and fully understand its terms and has had the opportunity to obtain independent legal advice on the above terms.

7. The undersigned agrees that in signing this Acknowledgement, they or the group are not relying on any oral, written, or implied representations or statements made by the Township of King with respect to the interpretation of this Acknowledgement or the safety of the Township of King’s premises.
